Legal Issues Raised by Section 125 Plans
Section 125 plans are authorized in the tax code. They are impacted by tax law, ERISA statutes and HIPAA regulations. This session will give the specifics on how states can make sure that their Section 125 plan program complies with federal law.

Implementation: Learning from Other States
The Massachusetts reform plan included a requirement that employers set up Section 125 plans for their employees, regardless of whether they provide insurance to those employees. The state has set up guidance for MA employers and have recently gotten feedback from employers in the state about how the program is working.
